The rules for using our website, making enquiries and buying trailers from us.

These terms of use ("Terms") govern your access to and use of the Simply Trailers website at https://www.simplytrailers.co.uk (the "Website"). By using the Website, you agree to these Terms. If you do not agree, you should not use the Website.

These Terms relate to use of the Website and general information we publish online. They do not replace the separate contract, quotation, invoice or order paperwork that applies when you buy a trailer from us. Where there is a conflict between these Terms and a signed or written sales agreement, the sales agreement prevails.

1. About us

The Website is operated by Simply Trailers, part of the Cool Running Trailers group, a UK trailer retailer supplying new trailers and related services.

2. Using the Website

You may use the Website for lawful purposes only. You must not:

  • Use the Website in any way that breaches applicable law or regulation.
  • Attempt to gain unauthorised access to our systems, data or accounts.
  • Introduce malware, harmful code or automated scraping that disrupts the Website.
  • Copy, reproduce, scrape or commercially exploit Website content without our prior written consent, except for personal, non-commercial use.
  • Misrepresent your identity or submit false or misleading information through our forms.

Availability

We aim to keep the Website available and accurate, but we do not guarantee uninterrupted access. We may suspend, withdraw or update all or part of the Website for maintenance, security or business reasons without notice.

3. Website information is not a binding offer

Trailer descriptions, photographs, specifications, dimensions, payloads, prices, availability, warranty summaries and other information on the Website are provided for general guidance only.

Catalogue content is compiled from manufacturer data and our own checks, but specifications can change, options vary, and images may not show every feature or finish. A listing on the Website does not constitute a binding offer to sell at the price shown.

All quotations, specifications, prices, delivery times and availability are confirmed by us in writing or in a recorded conversation before an order becomes binding.

4. Enquiries, quotations and orders

When you submit an enquiry or request a quotation, you are asking us to contact you. Submission does not create a contract to supply a trailer.

A contract for the sale of a trailer is formed only when we have agreed the key terms with you - including model, specification, price, delivery or collection arrangements, and any deposit or payment terms - and you have accepted our written quotation, invoice, order confirmation or equivalent sales documentation.

We reserve the right to refuse or cancel an order before acceptance, for example where a trailer is no longer available, a pricing error has occurred, or we reasonably suspect fraud or misuse.

5. Pricing, payment and VAT

Unless stated otherwise, prices on the Website and in quotations are shown excluding VAT. VAT will be added at the prevailing UK rate where applicable.

Payment terms, deposits, finance arrangements and settlement methods are confirmed in your quotation or invoice. We may suspend delivery or collection until cleared funds or agreed finance approval are received.

We are not responsible for bank charges, currency conversion costs or third-party finance fees charged by your payment provider or lender.

6. Delivery, collection and risk

Simply Trailers is Midlands based with nationwide delivery available. Delivery options, lead times and charges depend on trailer type, location, access and carrier availability.

Risk in the trailer passes to you on delivery, collection, or when you take possession, as stated in your order paperwork. You are responsible for inspecting the trailer on receipt and notifying us promptly of any transit damage or shortage.

You are responsible for ensuring your towing vehicle, licence category, nose weight, braking requirements and intended use are suitable and lawful for the trailer supplied.

7. Consumer rights

If you are a consumer buying from us, you have statutory rights under the Consumer Rights Act 2015 and, where applicable, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Trailers must be of satisfactory quality, fit for purpose and as described. Your rights may include repair, replacement, price reduction or refund depending on the nature, timing and severity of the issue.

  • Because trailers are often made to order, customised or supplied to your stated requirements, statutory cancellation rights may not apply in the same way as for off-the-shelf distance sales. We will explain your rights clearly before you commit.
  • If you are entitled to cancel under consumer law, we will confirm the cancellation period, any deductions permitted by law, and your return or collection obligations.
  • Your statutory rights are not affected by these Terms.

8. Business customers

If you are buying in the course of a business, trade or profession, the Website and these Terms are provided on a business-to-business basis to the extent permitted by law. Some consumer protections may not apply.

Any warranty, liability or remedy limits that are permitted for business customers will be set out in your quotation, invoice or sales contract.

9. Warranty and after-sales support

Warranty terms vary by trailer category and manufacturer. Summary warranty information is shown on the Website and category pages, but the warranty applicable to your trailer will be confirmed in writing at the point of sale.

As a general guide, many trailers we supply include a manufacturer warranty on chassis and structure, with shorter cover on wear items such as bearings, brakes, lights and tyres unless stated otherwise.

Warranty cover is subject to correct use, proper maintenance, lawful towing, and registration where required. Warranty claims should be reported to us promptly with supporting details. We will liaise with the relevant manufacturer or warranty administrator on your behalf where appropriate.

Warranty cover does not replace your statutory rights if you are a consumer.

10. Part-exchange and sell-your-trailer enquiries

If you offer a trailer for part-exchange or sale to us, any valuation is indicative until we have inspected the trailer and confirmed terms in writing. You warrant that you have authority to sell the trailer and that information you provide about its condition, history and ownership is accurate.

11. Towing, registration and use

You are responsible for ensuring the trailer is used safely and lawfully. This includes checking gross weight, nose weight, braking requirements, lighting, number plate display, type approval where relevant, insurance, and compliance with DVLA and DVSA rules.

We provide advice in good faith, but you remain responsible for confirming that the trailer and your towing combination are legal for your intended use on public roads.

12. Intellectual property

All content on the Website - including text, layout, logos, photographs, graphics, product descriptions and downloadable material - is owned by or licensed to Simply Trailers or the relevant manufacturer. You may view and print pages for personal reference, but you must not reproduce, distribute, modify or commercially exploit Website content without our prior written consent.

Manufacturer names, logos and product images remain the property of their respective owners and are used with permission or for identification purposes.

13. Reliance on information

We take reasonable care to ensure Website content is accurate, but we do not warrant that content is complete, current or free from error.

We are not liable for any action you take based solely on Website content without confirming details with our team. If you need advice on suitability, towing limits, payload, dimensions, brakes, refrigeration performance or bespoke options, speak to us before ordering.

14. Limitation of liability

Nothing in these Terms limits or excludes liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

Subject to that, and to the extent permitted by law:

  • We are not liable for loss of profit, loss of business, loss of opportunity, loss of data or any indirect or consequential loss arising from use of the Website.
  • Our total liability to you arising out of or in connection with use of the Website, whether in contract, tort (including negligence) or otherwise, is limited to £100 except where a separate sales contract provides otherwise.
  • We are not responsible for delays or failures caused by events outside our reasonable control, including manufacturer delays, transport disruption, severe weather, industrial action, power failure or third-party system outages.

15. Third-party links and services

The Website may link to third-party websites or services, including manufacturers, finance providers, mapping tools or social platforms. We do not control and are not responsible for those third-party sites, their content, availability or privacy practices.

16. Complaints

If you are a consumer and we cannot resolve a dispute, you may be entitled to use an alternative dispute resolution scheme or seek advice from Citizens Advice or Trading Standards.

Our use of personal data is explained in our privacy policy at https://www.simplytrailers.co.uk/privacy. By using the Website, you acknowledge that personal data you submit will be handled in accordance with that policy.

18. Governing law and jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or the Website are governed by the laws of England and Wales.

The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident in another part of the United Kingdom you may also bring proceedings in your home jurisdiction where consumer law allows.

19. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the bottom of this page shows when they were last revised. Continued use of the Website after changes are posted constitutes acceptance of the updated Terms.
